Agency fees and commission applicable on Syrian flagged vessels for non – transit cargoes


Tariff of agency fees and commissions to be collected by the shipping Agencies Company from vessels Calling Syrian ports and terminals according to the Decision No. 778 issued on 3/9/1988 by the Ministry of Transport effective 19 October 1988.

Tariff of agency fees and commissions to be collected by the shipping Agencies Company from vessels Calling Syrian ports and terminals according to the Decision No. 778 issued on 3/9/1988 by the Ministry of Transport effective 19 October 1988.


Agency fees and commission applicable on Syrian flagged vessels for non – transit cargoes

Tariff of agency fees and commissions to be collected by the shipping Agencies Company from vessels Calling Syrian ports and terminals according to the Decision No. 778 issued on 3/9/1988 by the Ministry of Transport effective 19 October 1988.

Article 1 – Agency Fees

For services rendered to vessels, the fees shall be fixed as follows:

Cargo Vessels

1- Schooners 

Schooners are those vessels of wood construction, powered by sails or engines of a  GRT  not exceeding 100, calling at Syrian ports from ports abroad (foreign or Arab), same shall be subject to pay a lump sum fee of SYR. PDS.  200.00 per call .

 

2- Ships

Ships are vessels intended for the carriage of cargo of various types  and methods of loading and handling including container, passenger and Ro/Ro vessels . These ships shall pay the following fees:

Vessel's GRT SYR. PDS.
101      -  1000 500.00        
1001     -  2000 1000.00
2001     -  3000 1500.00
3001     -  4000 2000.00
4001     -  5000 2300.00
5001     -  6000 2600.00
6001     -  7000 2900.00
7001     -  8000 3200.00
8001     -  9000 3500.00
9001     -  10000 3800.00
Vessels who's GRT exceeds 10000.00 an amount of SYP 300.00 shall be additionally collected per every 1000.00 GRT or fraction thereof.

 

  1. The above fees shall be reduced by 25% in case total cargo carried by vessels ( both loading and discharging ) does not exceed 100 tons.
  2. The fee fixed under paragraph A above shall be reduced by 50% in case any vessels calls at Syrian ports for the purpose of visit or to be supplied with provisions, fresh water, bunker, repairs and likewise and does not perform any commercial operation during the period of her stay.
  3. The fee fixed under paragraph A above shall be reduced by 50% for vessels registered at Syrian ports.
  4. The agency fee for any vessel should not be less than SYR. PDS. 500.00.
3- Tankers (oil and derivatives)

Such tankers shall be subject to pay the following fees:

Vessel's GRT  SYR. PDS.
Under –  5000 1500.00
5001  –  6000 1600.00
6001  -  7000 1700.00
7001  -  8000 1800.00
8001  –  9000 1900.00
9001  –  10000 2000.00

    

Vessels whose GRT is exceeds 10000, an amount of SYR. PDS. 100.00  shall be additionally collected per every 1000 GRT or fraction thereof.

Article 2 – Supplements to the tariff of agency fees

  1. Any vessels or tanker calling at or sailing from Syrian ports and terminals during the weekly holidays, official holidays or between 1800 hours of an ordinary day and 0700 of the next day, shall be subject to pay an additional fee amounting to SYR. PDS.  300.00
  2. Any vessel or tanker in port or terminal awaiting her berth shall be subject to pay SYR. PDS. 100.00 per day thereof.

Article 3 – Commission on vessel's freights

By freight we mean the basic freight plus all supplements, surcharges and other increases whatsoever.

A- Commission on vessel's freights

Such commission shall be collected on cargo carried by vessels intended for the carriage of cargo, or passengers, or containers, with the exemption of tankers and Ro/Ro vessels as follows:
  • 5% of outward freight of cargo booked by Shipping Agencies Company.
  • 3% of outward freight of cargo booked by Ship-owners or others.
  • 4% of inward freight of cargo booked by Shipping Agencies Company.
  • 2% of inward freight of cargo booked by Ship-owners or others.

 

B- Commission on Ro/Ro vessels

To be collected on cargo carried by Ro/Ro vessels, as follows:

  • SYR. PDS. 50.00 per every loaded truck discharged ex vessel or shipped on board.
  • SYR. PDS. 25.00 per every empty truck discharged ex vessel or shipped on board.
If such vessels are carrying cargo other than trucks, said cargo shall be subject to the commission fixed under paragraph A above.

Article 4 – Collection commission on freight payable at destination

Such commission shall be collected on inward freight payable at  Syrian ports at the rate of 1% of the amount of freight to be effectively collected and which includes the freight together with all supplements, surcharges and other increases.

Article 5 – Commission on passenger tickets

  1. The Company ( SHIPCO ) shall collect a commission on all passenger tickets which have been issued by it at the rate of 12% of the fare of each ticket.
  2. The said commission fixed under Article A may be divided as follows if the booking of the passenger ticket has been made by any authorized tourism office:
  • 6% of the ticket fare as minimum to the Shipping Agencies Company.
  • 6% of the ticket fare as maximum  to the booking tourism office.

Article 6 – container fees

A- The Company shall collect fees for tracking the containers during the various stages of transport and delivery as follows:
  • SYR. PDS. 30.00 PER 20' container or mafi.
  • SYR. PDS. 45.00 per 40' container or rail wagon.
B- The Company shall collect a commission of 5% on container demurrage amount effectively  collected by the Company for the account of shipping companies or Ship-owners.

Article 7 – Supervision and control fees on barges or lash vessels

The Company shall collect against supervision and control barges of LASH vessels at the port inside the break water an amount of SYR. PDS. 1000.00 per one barge.

Article 8 – Cargo handling charges

In addition to cargo handling charges settled to the port companies, Shipping Agencies Company  (SHIPCO) shall collect, from Ship-owners, per ton or fraction thereof for every B/Lading covering any kind of cargo the amount of SYR. PDS. 2.00 in case cargo is carried on Liner Terms, with the exception of inward cargo transported on trucks/trailers and carried on Ro/Ro vessels.

Article 9 – Hire of loading/discharging equipments

In case loading /discharging equipment is supplied by Shipping Agencies Company, the hire shall be collected from cargo owners or vessels as per terms of carriage at the rate of SYR. PDS. 3.00 per ton or fraction thereof.

Article 10 – Tally wages

  1. Shipping Agencies Company shall collect from Shipowners the amount of SYR. PDS. 2.00 per ton or fraction thereof of inward or outward cargo, irrespective of discharging or loading terms of carriage, with the exception of inward bulk cargo and cargo loaded or discharged through silos or valuators, as well as transit cargo in containers or in trucks carried on Ro/Ro vessels.
  2. The wages mentioned in paragraph A will be reduced 50% for vessels registered in Syrian ports.

Article 11 – cargo shifting an transshipment operations

  1. If shifting of cargo is effected inside the same vessel's holds and in whatever manner, SHIPCO shall collect, in addition to the ports company's dues, a service fee of SYR. PDS. 3.00 per ton or fraction thereof.
  2. If transshipment of cargo is effected from one vessel to another whatever the method is, the Company ( SHIPCO ) shall collect, in addition to the port company's  dues, a service fee fixed to SYR. PDS. 3.00 per ton or fraction thereof from each vessel.

Article 12 – Shipping fees

The Company SHIPCO shall collect as shipping fee an amount of SYR. PDS. 140.00 for every vessel or tanker calling at Syrian ports or terminals.

Article 13 – Various commissions and charges

The Company ( SHIPCO  ) shall collect from every ship or tanker calling at Syrian ports or terminals the following charges and fees per call:
  • A lump sum of SYR. PDS. 700.00 against mail, correspondence, local cables, fiscal stamps, local phone calls and sundry expenses.
  • SYR. PDS. 200.00, hire of motor boat for transportation per every trip at the vessel's requirement.
  • SYR. PDS.100.00, hire of car per hour of fraction thereof for internal transport inside town, at vessel's request.
  • Official cost of telex plus 20%.

Article 14 – Different commission and miscellaneous

  1. All charges and dues incurred by the port companies on reshipped containers are to be borne by the vessel unless the bills of lading provide otherwise.

  2. General average: In case of collision or general average, the Company (SHIPCO) shall collect a   service fee of SYR. PDS. 2000.00

  3. Salvage fees: The Company (SHIPCO) shall collect a commission of 5% of the salvage fees not less than SYR. PDS.5000.00 from the foreign party who benefited from the salvage fees or from Shipowners if salvage has been effected by local sides.

  4. Hire of motor boats at oil terminals: The hire of service motor boats employed at Syrian Oil Terminals shall be according to rates fixed or which shall be fixed by the General Directorate of Ports. The company (SHIPCO) is entitled to collect from owners of tankers the hire of two additional trips besides what is due from the tanker in order to secure the documents to the tanker outer line, and for facilitating tanker operations and expediting their entry to the line or departure from it. And this is in addition to motor boat hire fixed in Article 13.

  5. The Company (SHIPCO) shall collect SYP.PDS. 800.00 in whole from all vessels calling Rouad port per visit.

  6. Different commission:

1- The Company (SHIPCO) shall collect a commission of 10% of the amount of invoice covering services rendered to vessels: fresh water, provisions, ironing, washing, cleaning holds, erection of bulkhead inside the vessel's holds, recovery of ropes or packages from sea, survey report on vessels, certificates of classification and what rendered by other parties.

2- The Company (SHIPCO) shall collect the following amounts for services stated bellow:

  • SYR. PDS. 300.00 for attendance or for departure of crewmembers, not exceeding 3 persons. In case  the number exceeds 3, the Company shall collect SYR. PDS.  100.00 per each additional member.
  • SYR. PDS.  50.00 for accompanying the patient to the physician and securing the medicines without being hospitalized.
  • SYR. PDS.  50.00 for securing the requirements of the hospitalized patient for one day during hospitalization.
  • SYR. PDS.  950.00 for Company's supervising delivery or redelivery of a vessel in time or voyage charter.
  • SYR. PDS. 100.00 for securing the renewal or extension of one vessel's certificate.

Article 15 – Lawsuits and compromise settlements

A- The urgent pleas for survey and release of detained vessel:

SHIPCO collects, in addition to effective expenses and fees for each case, an amount of SYR. PDS. 1000.00 only. The said amount includes SHIPCO and lawyer's fees, the sundry and administrative expenses; cost of  translation;  to add to this amount:

  1. Cost of power of attorney, in case it is made.
  2. The effective cost of survey, if any.
  3. Effective cost of telexes.

 

B- The sea protest:

SHIPCO collects SYR. PDS.  400.00 only for every sea protest. This amount includes the cost of     registration of this protest in the harbor master and the cost of its registration in  the first    instance court.

To add this amount:

  1. Cost of power of attorney , if any.
  2. Other effective expenses, if any.

C- Compromise settlements:

1- Customs infringements:

SHIPCO collects for every customs infringement 2% of the amount of compromise settlement,  provided it is not less than SYR. PDS.  100.00 and not more than SYR. PDS. 4000.00.

2. Cargo claims:

SHIPCO collects for every compromise settlement 25% of the saved amount of the claim provided it is not less than SYR. PDS.25.00 and not more than SYR. PDS.5000.00.

D- Other lawsuits:

  1. SHIPCO collects for every lawsuit, the following amount:
  2. Cost of power of attorney.
  3. Effective cost of survey if any.
  4. Effective cost of telexes.
  5. Judicial dues paid to the court or the directorate of finance.
  6. Expenses of appeal and re-appeal paid to the courts.
  7. The fees for the lawyer, the share of advocate funds as well as SHICO, on every lawsuit, are as follows:

 Provided the following:
  1. The advance fees should not exceed SYP 20,000
  2. The balance fees should not exceed SYP 25,000.

Article 16 – Freight Manifests

In case no freight manifest or charter parties are received for the calculation of respective commissions, freight rates and supplements to be reckoned according to rate as fixed by the international conferences in case cargo is in liner terms, otherwise they are taken by analogy to the current rates applied in the date of shipment, provided the rates of freight be fixed every three months by a committee composing representatives from SHIPCO, SYRIAMAR and SYRNAV.

Article 17 – Interests

The company ( SHIPCO) shall collect interest at the rate of 9% per annum for amounts not settled after the passage of one month from the date of its claim.

Article 18

The Shipping Agencies Company shall collect one of the two remunerations mentioned in Article 1 or Article 3 whichever is higher, irrespective of the conditions of loading and discharging. Tankers shall remain subject to payment of agency fees as fixed according to their respective GRT.

Article 19

All services not mentioned in the present tariff shall be collected on basis of regular invoices and Shipping Agencies Company shall collect thereof a commission at the rate of 20% as maximum fixed as per a decision issued by the Minister of Transport according to the suggestion of the Administrative Committee of the Company.

Article 20

The provisions of the Decision No. 979 dated 30.12.1987 shall apply when this tariff is applied on foreign parties. This decision stipulates the following:

Article 1

The lump sum fees and charges provided for in the enclosed schedule of the decision No. 12 dated 8.1.1983 and amendments shall be collected by multiplying by 285% every item mentioned in the said schedule rounded up to nearest Syrian Pound when incurred on foreign sides not Syrian.

Article 2

The following rates of commissions are excluded from the provisions of the previous articles.
  • Freight commissions on vessels.
  • Vessel passenger tickets.
  • Collections of amounts of freight and container demurrages.

Agency fees applicable on Syrian flagged vessels for non-transit cargoes

Tariff of agency fees and commissions to be collected by the shipping Agencies Company from vessels Calling Syrian ports and terminals according to the Decision No. 778 issued on 3/9/1988 by the Ministry of Transport effective 19 October 1988.

 

Article 1 – Agency Fees

E- The above fees shall be reduced by 25% in case total cargo carried by vessels ( both loading and discharging ) does not exceed 100 tons.

F- The fee fixed under paragraph A above shall be reduced by 50% in case any vessels calls at Syrian ports for the purpose of visit or to be supplied with provisions, fresh water, bunker, repairs and likewise and does not perform any commercial operation during the period of her stay.

G- The fee fixed under paragraph A above shall be reduced by 50% for vessels registered at Syrian ports.

H- The agency fee for any vessel should not be less than SYR. PDS. 500.00.

6- Tankers (oil and derivatives)

Such tankers shall be subject to pay the following fees:

Under –  5000 1500.00
5001  –  6000 1600.00
6001  -  7000 1700.00
7001  -  8000 1800.00
8001  –  9000 1900.00

If such vessels are carrying cargo other than trucks, said cargo shall be subject to the commission fixed under paragraph A above.

  5. The Company (SHIPCO) shall collect SYP.PDS. 800.00 in whole from all vessels calling Rouad port per visit.

SHIPCO collects SYR. PDS.  400.00 only for every sea protest. This amount includes the cost of   registration of this protest in the harbor master and the cost of its registration in  the first instance court.

To add this amount:

  1. Cost of power of attorney , if any.
  2. Other effective expenses, if any.
C- Compromise settlements:

SHIPCO collects for every customs infringement 2% of the amount of compromise settlement,     provided it is not less than SYR. PDS.  100.00 and not more than SYR. PDS. 4000.00

Expenses of appeal and re-appeal paid to the courts.

The fees for the lawyer, the share of advocate funds as well as SHIPCO, on every lawsuit, are as follows:

25,001 – 50,000 7% but not less than SYP 2,000 8%
50,001  -  100,00 6% but not less than SYP 3,500 8%
100,001 and over 5% but not less than SYP 6,000 8%
Provided the following:
  1. The advance fees should not exceed SYP 20,000
  2. The balance fees should not exceed SYP 25,000.

Article 16 – Freight Manifests

In case no freight manifest or charter parties are received for the calculation of respective commissions, freight rates and supplements to be reckoned according to rate as fixed by the international conferences in case cargo is in liner terms, otherwise they are taken by analogy to the current rates applied in the date of shipment, provided the rates of freight be fixed every three months by a committee composing representatives from SHIPCO, SYRIAMAR and SYRNAV.

Article 17 – Interests

The company ( SHIPCO) shall collect interest at the rate of 9% per annum for amounts not settled after the passage of one month from the date of its claim.

Article 18

The Shipping Agencies Company shall collect one of the two remunerations mentioned in Article 1 or Article 3 whichever is higher, irrespective of the conditions of loading and discharging. Tankers shall remain subject to payment of agency fees as fixed according to their respective GRT.

Article 19

All services not mentioned in the present tariff shall be collected on basis of regular invoices and Shipping Agencies Company shall collect thereof a commission at the rate of 20% as maximum fixed as per a decision issued by the Minister of Transport according to the suggestion of the Administrative Committee of the Company.

Article 20

The provisions of the Decision No. 979 dated 30.12.1987 shall apply when this tariff is applied on foreign parties. This decision stipulates the following:

Article 1

The lump sum fees and charges provided for in the enclosed schedule of the decision No. 12 dated 8.1.1983 and amendments shall be collected by multiplying by 285% every item mentioned in the said schedule rounded up to nearest Syrian Pound when incurred on foreign sides not Syrian.

Article 2

The following rates of commissions are excluded from the provisions of the previous articles.

  • Freight commissions on vessels.
  • Vessel passenger tickets.
  • Collections of amounts of freight and container demurrages.
